By accessing or using NoCrast ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our Service. Your continued use of the Service constitutes acceptance of these terms and any modifications we may make.

2. Description of Service

NoCrast is a productivity and task management platform designed to help you overcome procrastination and achieve your goals. The Service includes:

AI-powered task breakdown and recommendations
Daily planning, scheduling, and timeline features
Progress tracking and productivity analytics
Customizable reminder notifications
Multi-device synchronization

3. User Accounts and Responsibilities

To use certain features of NoCrast, you must create an account. You are responsible for:

Maintaining the confidentiality and security of your account credentials
All activities that occur under your account, whether authorized or not
Immediately notifying us of any unauthorized access or security breach
Ensuring that your account information remains accurate and up-to-date
Being at least 18 years old, or having permission from a legal guardian

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts showing suspicious activity.

4. Subscription Plans and Pricing

Free Plan

The free plan includes:

Limited number of active goals and tasks as specified on the pricing page
Essential productivity features
Access to AI features subject to usage limits
AES-256-GCM encrypted data storage

Premium Plans

Premium subscriptions include:

Unlimited goals and tasks
Enhanced AI features with higher usage limits
Priority customer support
Advanced analytics and insights
All future premium features at no additional cost

Billing Terms

Premium plans are billed monthly or annually in advance
Subscriptions automatically renew unless canceled before the renewal date
Payment is processed securely through Stripe, our payment processor
All prices are in USD unless otherwise specified
We reserve the right to change pricing with 30 days advance notice to active subscribers
Existing subscribers will maintain their current pricing until their next renewal after the notice period

5. AI Features and Usage Limits

NoCrast utilizes artificial intelligence to provide task breakdowns, recommendations, and productivity insights. AI feature usage is subject to the following:

Token-Based Usage

AI features consume tokens based on the complexity of requests. Usage limits vary by plan:

Free plan: Limited AI tokens per billing period as specified on the pricing page
Premium plans: Generous AI token allocation that resets based on your billing cycle
Token limits are designed to support normal daily usage patterns
Your current usage and remaining tokens are displayed in your dashboard

Fair Use Policy

While we provide generous AI usage limits, we reserve the right to restrict access to users who:

Abuse the AI features through automated scripts or excessive requests
Use the Service for purposes other than personal productivity
Attempt to resell or redistribute AI-generated content

6. Cancellation and Refunds

How to Cancel

You may cancel your premium subscription at any time through your account settings. No phone calls, emails, or support tickets required. Upon cancellation:

Your subscription will not automatically renew
You retain full premium access until the end of your current billing period
No charges will occur on your next billing date
Your account will automatically convert to the free plan after your billing period ends
All your data remains safe and accessible within free plan limits

Refund Policy

We do NOT offer a money-back guarantee or refunds after the initial payment. Once you subscribe to a premium plan:

All payments are final and non-refundable
No refunds are provided for partial billing periods
No refunds for unused time if you cancel mid-cycle
Downgrading from annual to monthly plans does not qualify for refunds

Exceptions: We may consider refunds on a case-by-case basis only for:

Billing errors or duplicate charges caused by our payment system
Service outages lasting more than 72 consecutive hours
Fraudulent charges not authorized by you

7. Account Deletion

If you wish to permanently delete your NoCrast account and all associated data:

You must first cancel any active premium subscription
Contact our support team at support@nocrast.app from your registered email address
Request account deletion and confirm your identity
Our team will verify your request and process the deletion manually

Important: Account deletion is permanent and irreversible. All your data including:

All tasks, goals, and descriptions
Historical progress and analytics
Settings and preferences
Any remaining AI token balance

will be permanently deleted within 30 days and cannot be recovered. We recommend exporting any data you wish to keep before requesting deletion.

8. Acceptable Use Policy

To maintain a safe and productive environment for all users, you agree NOT to:

Use the Service for any illegal, harmful, or fraudulent purposes
Attempt to breach, bypass, or test the security or authentication systems
Interfere with or disrupt other users' access to the Service
Reverse engineer, decompile, or attempt to extract source code from the Service
Use automated tools, bots, or scripts to access the Service excessively
Upload malicious code, viruses, or harmful content
Harass, abuse, or harm other users or our support team
Impersonate others or misrepresent your affiliation with any person or entity
Collect or harvest user data without permission
Resell, redistribute, or commercialize the Service without authorization

Violation of this policy may result in immediate suspension or termination of your account without refund.

9. Intellectual Property Rights

Your Content

You retain full ownership of all content you create, upload, or store using NoCrast ("Your Content"), including tasks, goals, notes, and descriptions. By using the Service, you grant us a limited, non-exclusive license to:

Store, process, and transmit Your Content to provide the Service
Create backups and ensure data redundancy for security purposes
Use anonymized, aggregated data for service improvements and analytics

This license ends when you delete Your Content or close your account, except for anonymized data used in aggregate analytics.

Our Intellectual Property

NoCrast and all of its original content, features, functionality, design, code, and branding are owned by us and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Data Security and Privacy

Your use of NoCrast is governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

We take data security seriously and implement industry-standard measures including:

AES-256-GCM encryption for all task and goal data at rest
Unique encryption keys for each user
Secure data transmission using HTTPS/TLS protocols
Regular security audits and updates
Limited employee access to user data

11. Service Availability and Modifications

We strive to provide reliable, uninterrupted service but cannot guarantee 100% uptime. We reserve the right to:

Modify, update, or discontinue any aspect of the Service with reasonable notice
Perform scheduled maintenance that may temporarily affect availability
Suspend the Service for emergency maintenance or security updates
Add, remove, or modify features and functionality

We will provide advance notice of significant changes when reasonably possible, but are not liable for any unavailability or modifications to the Service.

12. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for:

Loss, corruption, or unauthorized access to your data or content
Service interruptions, errors, bugs, or technical issues
Indirect, incidental, consequential, or punitive damages
Lost profits, revenue, or business opportunities
Reliance on AI-generated recommendations or content
Third-party services or integrations

Our total liability to you for all claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless NoCrast, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use or misuse of the Service, (b) violation of these Terms, (c) violation of any third-party rights, or (d) Your Content.

14. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Service, without refund, if you:

Violate these Terms of Service or our Acceptable Use Policy
Engage in fraudulent or illegal activity
Fail to pay subscription fees when due
Abuse our support team or other users
Create multiple accounts to circumvent limitations

We will provide notice when reasonably possible before termination, but reserve the right to terminate immediately in cases of severe violations or security threats.

15. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices, features, or legal requirements. When we make changes:

We will update the "Last Revised" date at the top of this page
For significant changes, we will notify you via email or prominent in-app notification
Your continued use of the Service after changes become effective constitutes acceptance
If you disagree with changes, you must stop using the Service and cancel your account

16. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which NoCrast operates, without regard to conflict of law principles.

Binding arbitration if negotiations fail, conducted in accordance with applicable arbitration rules

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and NoCrast regarding the Service and supersede all prior agreements and understandings.
